Catch Certificate required for seafood imports to the European Union

The European Commission (EC) requires that fish and fishery products caught from 1 January 2010 can only be imported into a member country of the European Union when accompanied by an appropriate catch certificate, in accordance with Commission (EC) Regulation No 1005/2008 of 29 September 2008 establishing a community system to prevent, deter and eliminate illegal, unreported and unregulated (IUU) fishing.

Fishery Product that does NOT require the catch certificate

Fishery product caught before 1 January 2010, but exported after this date, does not require the catch certificate.

In addition, EC Regulation No 1010/2009 details those products which are excluded from the catch certificate requirement. A list of excluded products is detailed in Appendix 1 to this advice.

What catch certificate needs to be completed?

Until further notice, exporters of fish and fishery product must complete as appropriate, one of the EC catch certificate templates provided in Appendix 2 and Appendix 3 to this advice.

The catch certificate template  provided at Appendix 2, can only be used when the fishing vessel: 

  1. has an overall length of less than 12 metres without  towed gear; OR 
  2. has an overall length of less than 8 metres with  towed gear; OR 
  3. is without a superstructure; OR 
  4. is of less than measured 20 GT.

For all other fishing vessels,  the catch certificate template at Appendix  3 must be used.

A further Market Access Advice suggesting how you should  complete these catch certificate templates is currently being developed in  accordance the EC’s ‘Handbook on the practical application of Council  Regulation (EC) No. 1005/2008’.

Australian Government efforts to simplify the catch  certificate requirement

The Australian Government is  currently negotiating with the EC to implement a system whereby a catch  certificate will be issued automatically by the Australian Quarantine and  Inspection Service through its EXDOC system, at the same time as the EU Health  Export Certification is issued.

Exporters will be informed when  the Australian Government will be in a position to issue this automated catch  certificate through EXDOC.

Appendix 1

Fishery products that do not  require a catch certificate after 1 January 2010 and exported to the European  Union.

Annex XIII of EC  Regulation No 1010/2009 states that the following products do not require a  catch certificate to enter EU markets: 

  • Freshwater fishery  products

  • Aquaculture products  obtained from fry or larvae

  • Live ornamental fish

  • Oysters, live, fresh,  chilled, frozen, dried, salted or in brine

  • Scallops including  queen scallops, of the genera Pecten, Chlamys or Placopecten, live, fresh or chilled
  •  
  • Coquilles St Jacques (Pecten maximus), frozen
  •  
  • Other scallops, fresh  or chilled
  •  
  • Mussels, live, fresh,  chilled
  •  
  • Snails, other than  those obtained from the sea
  •  
  • Molluscs, prepared and  preserved
  •  
  • Other aquatic  invertebrates, prepared or preserved.

Annex V of EC Regulation No 1010/2009 also specifies  that the following species are exempt from this catch certificate, providing  they are harvested in compliance with regional fisheries management  organisation requirements and are accompanied by the appropriate catch  documentation prescribed by the relevant regional fisheries management  organisation: 

  •  Dissostichus spp. e.g. Patagonian toothfish
  •  
  • Bluefin tuna
  •  
  • Southern Bluefin Tuna *

* In addition to the Commission for the Conservation of Southern Bluefin Tuna catch documents, the importer shall submit to the authorities of  the EU Member State of importation information on ‘transport details’ as specified in the Appendix on transport details included in Annex II of the EC Regulation 1005/2008.

In addition to products listed above, the Department of Agriculture, Fisheries and Forestry is negotiating additional products to be excluded from the  requirements of the EC regulation. These include, but are not limited to, those  products listed below.

Negotiations are being based on characteristics of the fishery - including species from fisheries not harvested via a fishing vessel; caught wholly within internal  Australian waters; or highly processed products.

Important Note: these species currently require a catch certificate to be  imported into the EU.

  • Dosinia spp. – Clam -  Surf
  •  
  • Anadara spp. –  Cockle           
  •  
  • Donax spp. –  Pipi       
  •  
  • Katelysia  peronii, K. phytiphora, K. scalarina – Vongole
