2023-07: Fish - Management or control listing and export documentation requirements

Purpose

To advise stakeholders of company staff that should be listed on management or control of a fish export registered establishment.

Persons in management or control

Who should be listed on an establishment’s management or control?

Staff who have responsibility for ensuring the effective oversight and implementation of the export approved arrangement. Staff who have an obligation for ensuring that the export requirements, in part or in full, are being met. Staff who have authority to direct the export operations, or an important or substantial part of the export operations of an export registered fish establishment, should be listed as a person who manages or controls the export operations.

  • To add or remove a person(s) to management or control of your establishment - please complete an EX26b Application to register an export establishment.

Who does not need to be listed on an establishment’s management or control?

Automated export permit issuer (AEPI)

  • AEPI’s are no longer required to be listed on management or control to be able to complete a request for permit (RFP) in EXDOC on behalf of an establishment. Instead, the AEPI must be linked in EXDOC to the establishment(s) that they are providing this service for (for more information, refer to the AEPI section below).

Persons nominated in the Approved Arrangement (AA) as able to make export declarations

  • Individuals nominated in the AA as being able to make declarations (manufacturers declarations of compliance, transfer declarations) do not need to be listed in the management or control of the establishment (for more information, refer to the AA section below).

Authorised signatories and agents

  • The terms “authorised signatories” and “agents” are no longer used for dairy, egg, or fish commodities.

Automated export permit issuers (AEPIs)

  • To complete an RFP under the Export Control Act 2020 and associated Rules, you must be registered as an AEPI with the department.
  • To become an AEPI, you will need to complete the export permit issuer declaration of understanding form available on the department's website.
  • Once approved, an AEPI is provided with a unique and confidential automated export permit issuer number (AQA), which is used as an individual identifier.
  • Each AQA must be linked to the export registered fish establishment(s) they are approving RFPs for.
  • Please note, AQAs are confidential and should not be shared with anyone other than the person it is issued to. Sharing an AQA will result in immediate cancellation, and the re-issuance of a new AQA will be at the discretion of the department.
  • To request linking additional AQAs to an establishment(s), the AQA user should email dairyeggsfish@aff.gov.au providing the full name of the AEPI and the establishment’s name and number that they would like to be added to.
  • Please note, AQAs do not need to be listed in an establishment’s AA.

Persons nominated in an AA

Who can make declarations on behalf of the Occupier?

  • It is the responsibility of the Occupier of an export registered establishment to nominate individuals in their AA either by name or by a readily identifiable position title (i.e. QA Manager), who can make declarations of compliance related to exports on their behalf. This includes manufacturers declarations of compliance and transfer declarations.
