2022-68: Plant Export Operations – Public Consultation on the proposed amendments to the Export Control Rules 2021

Purpose

This Industry Advice Notice (IAN) is to advise that proposed amendments to the Export Control (Plant and Plant Products) Rules 2021 (Plant Rules) have been released for public consultation until 4:00PM AEDT on 20 January 2023.

Summary of changes and key points

  • The proposed amendments to the Plant Rules are now available on our Have Your Say page. This page also includes a series of information sheets.
  • The information sheets set out proposed amendments to the Rules for animals, meat, organic goods, plant, poultry, rabbit and ratite and wild game.
  • The Plant Rules provides official marks for plants and plant products intended to be exported from Australia.
  • The proposed amendments to the Plant Rules will allow greater flexibility for the sizing of ‘Australia Approved’ official marks.
  • We are proposing the Plant Rules include dimensions of a large size mark and a computer-generated mark that are ‘Australia Approved’ official marks.
  • The large mark would be applied in the same circumstances as a normal size mark, and the computer-generated mark would be applied to a computer-generated tag.
  • This is a minor amendment to the Plant Rules as ‘Australia Approved’ seals and marks are currently not in use for plants and plant products for export.
  • Feedback on the proposed amendments to the Plant Rules must be submitted on the Have Your Say page by 4:00PM AEDT on 20 January 2023.

Background

  • The Plant Rules are reviewed annually and where needed, amended. This is the second round of legislative amendments to the Plant Rules since the Export Control Act 2020 commenced on 28 March 2021.
  • The Plant Rules are subordinate to the Act and specify how plant and plant products prepared for export are regulated.
