42-2021: Updates to the Goods Determination to take effect 20 March 2021

Who does this notice affect?

This notice applies to importers, customs agents and industry stakeholders.

A new Biosecurity (Conditionally Non-prohibited Goods) Determination 2021 has been made to replace the Biosecurity (Prohibited and Conditionally Non-prohibited Goods) Determination 2016. 

This new determination is similar in effect to the 2016 determination. This is part of the department’s ongoing review of the effectiveness of import conditions including the appropriate application of import permits.

If you intend to import goods into Australian territory you must comply with the new determination.

What is changing?

The Biosecurity (Conditionally Non-prohibited Goods) Determination 2021 largely replicates the 2016 Goods Determination.

Under the Biosecurity (Conditionally Non-prohibited Goods) Determination 2021, the classes listed in Division 1 have been renamed in order to better align with the risk assessments that underpin them. These changes do not alter the goods listed, but simply more closely align the classes of goods with specific biosecurity risk they pose. No new classes have been added.

A few updates to import conditions have been included in the new determination, which is expected to have minimal impact on importers and industry stakeholders.

The new determination will come into force on 20 March 2021.
