62-2022: Updates to the Goods Determination to take effect 26 April 2022

Who does this notice affect?

This notice applies to regional officers, importers, customs brokers and industry stakeholders.  

What has changed?

Importers are advised that the Biosecurity (Conditionally Non-Prohibited Goods) Determination 2021 (Goods Determination) has been amended. This is part of the department’s ongoing review of the currency and effectiveness of import conditions and the appropriate application of import permits.

Import permits will no longer be required when importing goods (listed below) that have now been included in the Goods Determination. Import conditions must still be complied with. Many of the amendments reduce administrative burden (e.g. for both the department and the importers) without compromising the management of biosecurity risks, to facilitate trade. This aligns with the government’s trade agenda. The amendments also clarify and update several import conditions for various goods. Some changes make minor technical and inconsequential amendments. 

Goods imported into Australian territory on or after the 26 April 2022 must comply with the new legislation. Affected commodities are listed below.

From 26 April 2022, the following goods will no longer require an import permit (please note that prior to this date the current import conditions on BICON will apply):

  • Oyster shells that are not part of manufactured goods
  • Fish oil, other than fish oil derived from members of the family Salmonidae or the genus Plecoglossus including fish oil from New Zealand
  • Retorted avian and pork meat from New Zealand
  • Egg products from New Zealand
  • Egg noodles and egg pasta
  • Lysozyme
  • Listed semi-synthetic, fermentation-derived active ingredients for therapeutic use.
  • Pet fish food containing listed microalgae
  • Gelatine intended for cosmetics for human use
  • Preserved and fixed bees

From 26 April 2022, the import conditions for the following goods will be amended:

  • Goods intended for environmental purposes, including use as a bioremediation product or fertiliser.

Background

The Biosecurity (Conditionally Non-Prohibited Goods) Determination 2021 is regularly amended to ensure that import conditions are clear and consistent, are commensurate with biosecurity risk, and facilitate trade.  If you intend to import goods into Australian Territory you must comply with the new legislation.
