On 6 August 2014, the Russian President, Vladimir Putin, signed a Presidential Decree on the 'Application of Certain Special Economic Measures in order to protect the national of the Security of the Russian Federation'.

This Decree imposes immediate bans, for one year, on imports of specified agricultural products originating from countries including Australia, United States, European Union, Norway and Canada. An unofficial translation of the Decree is provided at Attachment 1.

The unofficial translation of the list of agricultural products, raw materials and food affected by the decree, identified by HS (Harmonized Systems) Code, is provided at Attachment 2.

It is unclear whether Russia will allow entry of product, covered under the Decree, that is currently en-route to Russia. The department is urgently seeking clarification in this regard. In the interim, exporters are advised to consider alternate market / ‘return to Australia’ options. The department will work with exporters to facilitate re-certification for alternate markets and import permits for product returning to Australia:

  • To discuss re-certification arrangements, exporters should contact: foodexportdocumentation@aff.gov.au
  • To discuss ‘return to Australia’ arrangements, exporters should contact: biologicals@aff.gov.au. If exporters do intend or may wish to return product to Australia we would advise, where possible, they keep container seals intact.

The department is not aware of any information to suggest that the list of products covered under the Decree will be expanded. However, exporters of products not currently included on the list are advised to exercise caution and liaise with their importers to assess whether consignments will be permitted entry on arrival to Russia.

The department will keep exporters updated of any relevant developments.

The information provided above is current at the time of writing and is intended for use as guidance only and should not be taken as definitive or exhaustive. The Commonwealth endeavours to keep information current and accurate, however, it may be subject to change without notice. Exporters are encouraged to verify these details with their importersprior to undertaking production/exports. The Commonwealth will not accept liability for any loss resulting from reliance on information contained in this notice.
