Industry Advice Notice no. 2006/32 - Amendment to the Export Control Plant and Plant Products Orders 2005

This Industry Advice Notice is to inform of an amendment to the Export Control (Plants and Plant Products) Orders. The amendment clarifies the existing requirement that the export of prescribed goods is prohibited unless there is a valid export permit in force.
The prescribed goods required to have a valid export permit at the time of export are:
- Fresh fruit (all destinations)
- Fresh vegetables (all destinations)
- Dried fruits (all destinations)
- Prescribed grains (all destinations)
- Nursery stock and cut flowers/foliage (to Phytosanitary destinations only)
The export permit may be issued if all conditions of the Orders are met for these goods.
Before a valid export permit will be issued the following actions must have been taken:
a. EX28 has been appropriately endorsed (reflecting the passed goods), stamped with the official DAFF seal signed and dated by an authorised officer in the Export Permit section at the bottom of the form; or
b. RFP has been authorised in accordance with approved procedures, reflects the goods passed for export and the RFP has a status of “HCRD” or “COMP”; or
c. fully completed Export Clearance Declaration (EX222) has been lodged with AQIS following preparation of prescribed goods for export in accordance with an approved arrangement and the legislation.
Once issued an export permit remains valid for a period of 28 days, unless it has been revoked.
