Who does this notice affect?
Customs brokers who lodge import declarations for goods classified under tariff chapter 94 - Furniture; bedding, mattresses, mattress supports, cushions and similar stuffed furnishings; lamps and lighting fittings, not elsewhere specified or included; illuminated signs, illuminated name-plates and the like; prefabricated buildings
What has changed?
Unforeseen issues in the Integrated Cargo System (ICS) have caused several community protection (CP) profiles for goods in tariff chapter 94 to cease operation. Brokers may not be asked the CP question that would normally refer the goods to the department. When there are no other referrals on an import declaration, this may cause the entire import declaration to have a CLEAR ICS status.
The affected profiles were reactivated from 24 November 2018. The Departments of Agriculture and Water Resources and Home Affairs are working on a permanent fix for this issue.
In the interim, if you suspect an import declaration you have lodged has an incorrect CLEAR status, brokers can either:
- Amend the import declaration to enter the concern type BCOM
- Lodge documents in COLS and request the import declaration be manually referred to the department for assessment.
No non-compliance action will be taken where it can be demonstrated that goods were not referred to the department due to this issue. No fees for service charges will be applied for import declarations that would have otherwise been processed through Automatic Entry Processing for Commodities (AEPCOMM).
