We publish a list of documents we have released in response to Freedom of Information (FOI) requests as required by the Freedom of Information Act 1982 (FOI Act). We publish these documents within 10 business days of release to the FOI applicant.

All information included in this log is available for public access.

Check this log before you make a new FOI request.

We also help portfolio Ministers to comply with disclosure obligations. Our disclosure log provides details in relation to any documents released by the office of a portfolio Minister.

What we don’t publish

We don't publish information that would be considered 'unreasonable' to publish, unless it can be practically modified. This includes:

  • personal information about any person
  • information about the business, commercial, financial or professional affairs of any person
  • other information covered by a determination made by the Australian Information Commissioner

Key documents that show how the following figures (of $300 million, 3½ years and 1,401 days) were calculated in the Minister’s media release for the EPBC Act review on 29 October 2019 (Appendix 1) and the Minister’s op-ed in the Australian Financial Review, 3 November 2019 (Appendix 2):

  • “Delays in EPBC decisions are estimated to cost the economy around $300 million a year”
  • “The average approval time for a major project referred under the EPBC Act at present is estimated at 3½ years. Cutting these approval times could save business more than $300 million a year.”
  • “In the past four years, 1,401 days have been spent on court cases over applications, including before the Federal Court and even the High Court.”

Note: I do not request all documents related to these statements or the media release or op-ed. I only request the key documents that show the basis for the calculation of these figures. If the figures are based on particular EPBC Act referrals or court cases, a list of the referrals or court cases would be sufficient to satisfy the request.
