What we don’t publish

We don't publish information that would be considered 'unreasonable' to publish, unless it can be practically modified. This includes:

  • other information covered by a determination made by the Australian Information Commissioner

1.   • a copy of any other information that forms part of or is attached to an agreement between the NSW Office of Environment and Heritage and/or NSW National Parks and Wildlife Service, and the Proponent, that has been entered into for the purpose of fulfilling the Offset Requirements, that indicates the location and/or dimension of the ‘offset areas’ (as defined in EPBC 2010/5566); or
  • all written correspondence (being emails or letters) that was created between 7 February 2018 and 10 October 2018 that indicates the location and/or dimensions and/or boundaries and/or areas of the ‘offset areas’ that have been secured (as defined in EPBC 2010/5566).

Note: This request (i.e the request at paragraph 1) is restricted to documents dated and/or created between 7 February 2018 and 10 October 2018.

2. In the event that Whitehaven Coal Limited and/or Aston Coal 2 Pty Ltd (the Proponent) has not yet secured legally binding covenants over some or all of the ‘offset areas’ required for the purpose of fulfilling the offset requirements under Conditions 9-13 of the Approval given under the Environment Protection and Biodiversity Conservation Act 1999 (Cth) for the Maules Creek Coal Mine Project (EPBC 2010/5566) :

  • a copy of the latest iteration of any maps held by the Commonwealth Department of the Environment that identify the areas of land over which the Proponent intends and/or proposes to register legally binding covenants pursuant to Conditions 9-13 of the abovementioned Approval; and
  • All written correspondence (being emails or letters) that was created between 7 February 2018 and [the date of the FOI Application] that indicates the location and/or dimensions and/or boundaries and/or areas of the proposed ‘offset areas’ (as defined in EPBC 2010/5566) being the land over which the Proponent intends and/or proposes to register legally binding covenants pursuant to Conditions 9-13 of the abovementioned Approval

On Monday 22nd May 2017 the Minister for Energy and Environment (as he then was), Josh Frydenberg announced that a $390,000 grant from the Australian Renewable Energy Agency (ARENA) would be awarded to ClimateWorks in order to promote the uptake of electric vehicles in Australia.

Patrick Finnegan submits a Freedom Of Information Request under Section 11 of the Freedom of Information Act 1982 (Cth) and seeks:

  1. A schedule of all documents relating to the decision made by ARENA to award the grant of $390,000 to Climate Works to promote the uptake of electric vehicles in Australia.
  2. Copies of the following documents or types of documents:
    • A copy of the application for funding made by Climate Works to ARENA and copies of any ancillary documentation supplied by Climate Works in support of the application.
    • Details of the decision criteria applied to the approval of funding on foot of the application for funding submitted by ClimateWorks.
    • An explanation of why funding ClimateWorks and the EV Council was considered the most effective way of promoting the uptake of electric vehicles in Australia.
    • A description of the relationship between ClimateWorks and the EV Council and details of the subsequent distribution of funds between ClimateWorks and the EV Council.
    • A copy of the agreement between ARENA and ClimateWorks/EVCouncil describing, amongst other things, the guidelines laid down by ARENA governing disbursement of the funds by ClimateWorks/EV Council and details of any activities excluded from funding and any limitations on how the funding could be spent.
    • A detailed line item breakdown of how ClimateWorks/EV Council have used the funding to promote electric vehicles and a statement of account showing transfers of ARENA funds between ClimateWorks/EV Council and third parties and any balance remaining.
    • A description of how ARENA intend to audit Climate Works/EV Council to ensure that the funding was spent appropriately.
