2020-58 - Plant Export Operations - Release of the Draft Export Control (Plants and Plant Products) Rules 2020 for the second round of consultation

Purpose

This Industry Advice Notice (IAN) is to advise that the Draft Export Control (Plants and Plant Products) Rules 2020 has been released for the second round of public consultation until COB 5 November 2020.

Summary of changes and key points

  • The Draft Export Control (Plants and Plant Products) Rules 2020 (draft plant rules) is available on the department’s Have Your Say page.
  • This is the second round of public consultation on the draft plant rules.
  • The page includes a series of explanatory factsheets about the new plant export legislation and on the key changes since the first round of public consultation.
  • Feedback on the draft plant rules must be submitted on the Have Your Say page by COB 5 November 2020.

Background

  • The current agricultural export legislation is due to expire on 1 April 2021. Consequently the department is developing improved agricultural export legislation for Australia.
  • The Export Control Act 2020 (the Act) and its subordinate legislation will commence on 28 March 2021.
  • The draft plant rules are subordinate to the Act and set out the operational requirements that must be met to export plants and plant products from Australia. The draft plant rules will replace the existing regulations and plant orders and should be read in conjunction with the Act.
  • The draft plant rules were published on 18 May 2020 and the first round of consultation closed on 26 June 2020. Following consultation, the draft plant rules were amended to ensure that they will be fit for purpose.
