Request an extension or withdrawal

This form is for requests to the Director of Biosecurity for an extension of time to pay an infringement notice, or withdrawal of an infringement notice.

Note that if you are making this request on behalf of a person who has received in infringement notice, you will need to complete an Authority to Act form and include it with the request.

You will receive written confirmation of your submission within 10 business days. The Director of Biosecurity (or delegate) will review your request to withdraw an infringement notice according to the Regulatory Powers (Standard Provisions) Act 2014, a process that may take up to 90 days.

You will receive a refund of the money you have paid if the infringement notice is withdrawn.

If your payment period has closed, you are unable to request an extension of time to pay. If you wish to make payment, please contact the INU via phone on 02 6272 4965 during office hours (8.30am - 4.30pm, Monday - Friday AEST) If your payment period is open, a form will get sent to INU for review.

Personal information that is obtained or generated in the course of, or for the purposes of performing powers, functions, and duties under the Biosecurity Act 2015 (Cth) (Biosecurity Act) is also ‘relevant information’ under the Biosecurity Act. Sensitive information that is collected under or in accordance with the Biosecurity Act is also 'protected information' under the Biosecurity Act.

The Department of Agriculture, Fisheries and Forestry (department) collects your personal information via the departments infringement notice forms and email address for the purposes of:

The management of matters relating to the giving of issuing of infringement notices, including, but not limited to, requests for extensions to pay, requests for withdrawal of a notice and providing authority for another person to act;
Monitoring and investigating the issuing giving of infringement notices;
Processing and investigating any complaints or feedback received by you;
Carrying out functions as permitted under the Biosecurity Act or the Regulatory Powers (Standard Provisions) Act 2014 (Regulatory Powers Act); and
Any related purposes.

The department is authorised to collect your personal and sensitive information under the Biosecurity Act and the Regulatory Powers Act.

If you fail to provide some or all of the personal information requested in this form or in our correspondence, the department may be unable to process your request.

The department may disclose your personal information to other Australian government agencies, persons or organisations where necessary for the above purposes, provided the disclosure is consistent with relevant laws, in particular the Privacy Act 1988 (Cth), the Biosecurity Act and the Regulatory Powers Act. Your personal information will be handled in accordance with the Australian Privacy Principles, the Biosecurity Act, and the Regulatory Powers Act.
