What we don’t publish

We don't publish information that would be considered 'unreasonable' to publish, unless it can be practically modified. This includes:

  • personal information about any person
  • information about the business, commercial, financial or professional affairs of any person
  • other information covered by a determination made by the Australian Information Commissioner

[Item 2] Correspondence between the Department of Environment and Energy and the Great Barrier Reef Foundation regarding the $443 million grant between 1 Feb and April 30 2018. 

[Item 3] Any interactions/meetings/hospitality between any of the board members of the Great Barrier Reef Foundation or its managing director Anna Marsden and Department of Environment secretary Finn Pratt , in which the finances of the foundation were discussed, since 1 Jan 2018.

[Item 4] Diaries for 9 April for Department of Environment officials Pratt, Oxley, Knudson and Callister.

  1. I refer to the decision by Mr Shane Gaddes dated 19 November 2015 varying the conditions of approval for “Burnside Development - The Point, Victoria - EPBC 2011/6063” as on the Department’s website. In relation to this decision, I ask for a copy of the documents stimulating the changes for paragraphs 13 and 16 of the conditions, documents showing the process involved in making the changes, plus any documents that contribute to explaining:
    • the reasons for the change
    • the reasons for the change at that time;
    • the rationale for the wording of the amendments, including the reasons for not stating a specific size of offsets in the variation for paragraphs 13 and 16
    • the contribution of the developer or any other entity to making and/or negotiating the variation
    • the reaction of the developer or any other entity to the decision.
  2. I refer to the “Consolidated Approval Notice Burnside Development - The Point, Victoria (EPBC 2011/6063)” signed by Mr James Baker on 4 August 2017 as on the Department’s website, and specifically to paragraphs 6, 6A, 8,13 and 16 of the conditions. In relation to these paragraphs, I ask for a copy of the following documents:
    • documents showing the stimulus for the changes and documents showing the process involved in making the changes to offsetting destruction of grasslands and habitat of the Striped Legless Lizard as written in the original decision of 20 July 2015 and the amended decision of 19 November 2015, plus any documents that contribute to explaining:
    • the reasons for the change;
    • the rationale for the wording of the amendments, including the reasons for not stating a specific size of offsets in the new paragraphs;
    • the contribution of the developer or any other entity to making and/or negotiating the variation
    • the reaction of the developer or any other entity to the decision.
  3. I relation to paragraph 6A of the “Consolidated Approval Notice Burnside Development - The Point, Victoria (EPBC 2011/6063)” signed by Mr James Baker on 4 August 2017, I ask for documents relied upon by the Department to justify paragraph 6A(b) and explain:
    • why the Department considers that the 'Burnside Development' meets the criteria of the Melbourne Urban Development Policy; and
    • what manner of offsetting by the company for this development the Department considers to be consistent with the Melbourne Urban Development Policy.

I ask that all departmental staff names written in such documents supplied to me be unredacted.
