10 April 2018

The purpose of this Industry Advice Notice (IAN) is to advise exporters that the interim report from the Department of Agriculture and Water Resources’ review of the Port Terminal Access (Bulk Wheat) Code of Conduct (the Wheat Port Code) has been released for comment.

Summary of changes and key points

  • The department has released the interim report from its review of the Wheat Port Code on its stakeholder engagement platform Have your Say.
  • The department invites you to provide feedback on the interim report by uploading a written submission through Have your Say.
  • The department will arrange meetings with industry stakeholders to discuss their views. We are also available to meet with you in Canberra or to attend key industry events.
  • Submissions close Friday, 1 June 2018. The department will consider all submissions before completing its final report and providing it to government.

IAN 2017-39 advised exporters that the department had started a review of the Wheat Port Code. Stakeholders were also invited to provide comment on the existing code and associated issues paper.

The Wheat Port Code regulates bulk wheat port terminal service providers to ensure bulk wheat exporters have fair and transparent access to port terminal services.

The Wheat Port Code replaced the ‘access test’ provisions of the Wheat Export Marketing Act 2008 after the repeal of the Act in 2014. The Australian Competition and Consumer Commission enforces the code.
