We publish a list of documents we have released in response to Freedom of Information (FOI) requests as required by the Freedom of Information Act 1982 (FOI Act). We publish these documents within 10 business days of release to the FOI applicant.

All information included in this log is available for public access.

What we don’t publish

We don't publish information that would be considered 'unreasonable' to publish, unless it can be practically modified. This includes:

  • personal information about any person
  • information about the business, commercial, financial or professional affairs of any person
  • other information covered by a determination made by the Australian Information Commissioner

In relation to the answers provided to Question 115 from the Senate Standing Committee on Environment and Communications Legislation Committee, I ask for:

1. Documents prepared between 2017 and 2020 discussing:

  • the impending failure of Victoria to establish the Western Grassland Reserves by 2020
  • the need, or not, for a remedial plan, or some similar documents, to counter this failure
  • the relationship of this failure to the conditions contained in the Melbourne Strategic Assessment program report or the EPBC Act
  • reasons why “Not securing the Western Grassland Reserve in its entirety by 2020 will not constitute a contravention of the conditions attached to the Part 10 approvals”, (including any communications between the Department and Victoria, DELWP or other parties in relation to any of these topics during that period and notes of any discussions between the Commonwealth and the Victorian Government “around opportunities to ensure that the environmental outcomes envisaged by the program are met”).

2. Complete copies of any and all risk assessment and treatment plans maintained during the operation of the Melbourne Strategic Assessment Program and any documents, such as communications, that explain, or provide background on, or discuss those plans

3. Documents showing the agreed amendments made to activities and/or processes, as contemplated by the Melbourne Strategic Assessment Program, since the endorsement of the Program.

4. Copies of all reports by members of the Department’s Office of Compliance of observations made of activities in relation to the Western Grassland Reserves, including those in 2016 and 2019.

5. Copies of notes and outcomes of the discussions held in 2015, 2016 and since between the Department and the Victorian Government (DELWP) regarding the development of a compliance strategy for the MSA Program

  • documents explaining what compliance issues under the MSA Program that the Melbourne Strategic Assessment (Environment Mitigation Levy) Bill 2019 will address
  • drafts of any compliance strategy prepared by DELWP held by the Department
  • documents illustrating the position of the Department or DELWP on public involvement in the process of formal consultation, endorsement and finalization of the strategy.

6. Documents showing when the on-ground surveys and quality assured modeling were conducted for the preparation of the attached map of the Western Grassland Reserves, and the reliability of the data for those surveys and modeling to represent the quality of the grasslands at 2019-2020 as in the attached map.

7. Copies of any communications from the Department to Victoria asking for any economic analyses of the Western Grassland Reserves.
