What we don’t publish

We don't publish information that would be considered 'unreasonable' to publish, unless it can be practically modified. This includes:

  • information about the business, commercial, financial or professional affairs of any person
  • other information covered by a determination made by the Australian Information Commissioner

Information and or briefings on the natural temperate grassland of the south eastern highlands that were prepared ahead of meetings between the Minister and the Prime Minister and/or their staff. In seeking this information I request the following:

  • All briefs, including drafts circulated within the department
  • All briefs, including drafts, supplied to the Minister or the Prime Minister and/or their offices
  • The entire briefing pack prepared for the meeting referenced in departmental emails dated Tuesday 30 January, 2018. For your reference, please see Question on Notice 230 from supplementary budget estimates https://www.aph.gov.au/Parliamentary_Business/Senate_estimates/ec/2019-…. The entire briefing pack in this instance means the brief on the grasslands plus any other briefings on other issues relevant to the Environment portfolio that were prepared as part of a package for this meeting. I include drafts in this request. For the avoidance of doubt, I do not require any briefings related to issues that sit within the Energy portfolio. 
  • I also request any correspondence related to the above grasslands briefing: this means any requests from the Minister, the Prime Minister or staff in either of their offices for this information, any follow up correspondence from the Minister, the Prime Minister or staff in either of their offices once this information was supplied, and any internal departmental correspondence relating to the preparation of this grasslands brief or any follow-up information (including emails to and from staff). When I say correspondence, I am referring to emails, meeting records, diary records, notes from meetings, notes from phone calls and any messages (whatsapp, sms etc). 
  • Any other records of meetings between the Minister and the Prime Minister regarding the natural temperate grassland of the south eastern highlands or the compliance case against Jam Land Pty Ltd. In requesting records I also ask for any internal departmental correspondence relating to such meetings.
  • Any other additional briefs on either the grasslands or the compliance case against Jam Land Pty Ltd that were prepared for meetings between the Minister/his office and the Prime Minister/his office. In requesting this, I also request any internal departmental correspondence relating to the preparation of such briefs.

On 9 December 2019, Andrew McNee, Assistant Secretary Assessments and Governance Branch, as delegate of the Minister for the Environment, decided the assessment approach and controlling provisions for the North Galilee Water Scheme (EPBC 2019/8508). The decision was published on the EPBC Act referrals list website here.  

I request access to those documents within the package of documents prepared by the Department (normally called the ‘decision brief’) that the delegate considered in making the decision.

1. The most recent version of the Biodiversity Offset Strategy submitted as a requirement of Condition 6 of the Conditions of Approval (EPBC 2011/6181) (approved on 2 May 2013 or subsequent revised documents).

2. The most recent version(s) of any Biodiversity Offset Management Plans that have been approved or accepted by DOEE as defined in the Biodiversity Offset Strategy (Condition 6 of the Conditions of Approval: 2011/6181).

Please limit documents to only those that outline monitoring and reporting commitments for the Biodiversity Offset for the above project.

3. Documents submitted to DOEE that report on the progress/management/condition of Biodiversity Offsets, as defined in the Biodiversity Offset Strategy (Condition 6 of the Conditions of Approval).

Please limit documents to only those that report on monitoring for the 2018 and 2019 periods.
