We publish a list of documents we have released in response to Freedom of Information (FOI) requests as required by the Freedom of Information Act 1982 (FOI Act). We publish these documents within 10 business days of release to the FOI applicant.

All information included in this log is available for public access.

We also help portfolio Ministers to comply with disclosure obligations. Our disclosure log provides details in relation to any documents released by the office of a portfolio Minister.

What we don’t publish

We don't publish information that would be considered 'unreasonable' to publish, unless it can be practically modified. This includes:

  • personal information about any person
  • information about the business, commercial, financial or professional affairs of any person
  • other information covered by a determination made by the Australian Information Commissioner

I write under the provisions of the Commonwealth Freedom of Information Act to request documents from the files of the Department of the Environment and Energy, including the Minister’s office.
I refer to the emails provided to me by your department in response to my FOI request 160606 and attached to this email as Attachment 1 and Attachment 2.
1. In the first email of Attachment 1, the then Director - Victoria and Tasmania Section, presumably Charmayne Murray, writes: “From our perspective the proposed decision is consistent with the MSA and MUD policy ….. “.
Please provide me with:
i) an unredacted copy of the first email in Attachment 1; and
ii) unredacted copies of all documents held by the Department that staff of the then Victoria and Tasmania Assessment Section or any other section or staff member used to justify the idea put forward (as stated by the then Director - Victoria and Tasmania Section) that the then proposed decision for this development (EPBC Ref No 2011-6063) was consistent with the MUD Policy (Policy Statement for Melbourne urban development proposals needing consideration under Parts 7, 8 and 9 of the EPBC Act).
2. In Attachment 2, the Assistant Director, Victoria and Tasmania Assessment Section states in the email of 20 February 2015: “I explained that consistent with the policy, SLL can be offset into the WGR.”
Please provide me with:

i) an unredacted copy of the email of 20 February 2015 and the email of 23 February 2015; and

ii) unredacted copies of all documents held by the Department that the then Assistant Director, Victoria and Tasmania Assessment Section used to justify the idea put forward in the 20 February email that offsetting the destruction of Striped Legless Lizard habitat at the relevant development site into the Western Grassland Reserve could be consistent with the policy (presumably 'Policy Statement for Melbourne urban development proposals needing consideration under Parts 7, 8 and 9 of the EPBC Act’).
