• Copy of the WA Minister’s Report for the period 2015/2016 to the NEPC (as contemplated to be provided to the NEPC by the WA Minister under section 23 of the National Environment Protection Council (Western Australia) Act 1996);
• Copy of the WA Minister’s Report for the period 2016/2017 to the NEPC (as contemplated to be provided to the NEPC by the WA Minister under section 23 of the National Environment Protection Council (Western Australia) Act 1996); and
• Copy of the current final draft of the NEPC Annual Report for the period 2016/2017 (as contemplated under section 24 of the National Environment Protection Council (Western Australia) Act 1996 will be prepared for and ultimately adopted formally by the NEPC). This request only seeks that material within the draft that relates generally to Australia and specifically to Western Australia. This request does not capture material that specifically relates to other States or Territories.

I write under the provisions of the Commonwealth Freedom of Information Act to request documents from the files of the Department of the Environment and Energy, including the Minister’s office.
I refer to the emails provided to me by your department in response to my FOI request 160606 and attached to this email as Attachment 1 and Attachment 2.
1. In the first email of Attachment 1, the then Director - Victoria and Tasmania Section, presumably Charmayne Murray, writes: “From our perspective the proposed decision is consistent with the MSA and MUD policy ….. “.
Please provide me with:
i) an unredacted copy of the first email in Attachment 1; and
ii) unredacted copies of all documents held by the Department that staff of the then Victoria and Tasmania Assessment Section or any other section or staff member used to justify the idea put forward (as stated by the then Director - Victoria and Tasmania Section) that the then proposed decision for this development (EPBC Ref No 2011-6063) was consistent with the MUD Policy (Policy Statement for Melbourne urban development proposals needing consideration under Parts 7, 8 and 9 of the EPBC Act).
2. In Attachment 2, the Assistant Director, Victoria and Tasmania Assessment Section states in the email of 20 February 2015: “I explained that consistent with the policy, SLL can be offset into the WGR.”
Please provide me with:

i) an unredacted copy of the email of 20 February 2015 and the email of 23 February 2015; and

ii) unredacted copies of all documents held by the Department that the then Assistant Director, Victoria and Tasmania Assessment Section used to justify the idea put forward in the 20 February email that offsetting the destruction of Striped Legless Lizard habitat at the relevant development site into the Western Grassland Reserve could be consistent with the policy (presumably 'Policy Statement for Melbourne urban development proposals needing consideration under Parts 7, 8 and 9 of the EPBC Act’).

All briefs (signed or otherwise, including any drafts) and correspondence provided from the Department of the Environment and Energy to the Environment and Energy Minister or his office between 1 April 2017 and 31 July 2017 that relate to the Toondah Harbour Development in Queensland (EPBC 2015/7612 and 2017/7939).

1. The letter written by Mark Beaufoy, then of DLA Piper Australia on behalf of Intrapac Projects to Cameron Allen and Naomi O’Brien, then of the Department on 13 May 2011, entitled “Residential development: 115 Westmeadows Lane, Truganina Vic, EPBC Act reference no. 2010/5791”.
2. The email written by Department staff on 30 May 2011 to DLA Piper in relation to “Residential development: 115 Westmeadows Lane, Truganina Vic, EPBC Act reference no. 2010/5791”; and
3. If the email of point 2 is not the response to the letter of point 1, any communication written by Department staff in response to the letter of point 1.

Correspondence dated 1 December 2017 to 7 June 2018 between the Department and the office of the Minister for Environment and Energy that mentions proposed or agreed provisioning of funding (including loans) to the Antarctic Science Foundation for purposes related to the establishment or initial operations of the Antarctic Science Foundation.

Any and all documents relating to Australia's national greenhouse gas inventory for the June 2017 quarter and any and all documents relating to Australia's national greenhouse gas inventory for the September 2017 quarter.

Documents relating to any meetings between any staff from the Department of Environment and Energy and Senator Barry O’Sullivan (or his representatives) that relate to land clearing or agriculture development since January 2015.
Including Diary entries and meeting requests; notes of meetings, including file notes and email correspondence; and, documents exchanged in the course of, or as a result of the meetings.

The first and (if they are different) last minute or other internal document(s) which record the decision to sell environmental water in the Gwydir valley as announced publicly in January 2018.
