About the Guidelines

The Levy guidelines: How to establish or amend agricultural levies aim to support agricultural, fisheries and forestry industries step-by-step through the process of developing a proposal to establish or amend a legislated agricultural levy or charge.

The department will refer to the guidelines in assessing the soundness of a levy proposal and advising the responsible Minister on likely associated costs of collection and the regulatory impact on levy payers, collection agents, and the legislative changes necessary to implement a levy proposal. The minister decides whether to agree to the proposal.

The guidelines are designed to complement the Australian Government’s ‘General principles applying to proposals for new and amended primary industries levies and charges’ (the Levy principles ), introduced in 1997, and outlined in the guidelines.

Process to amend or establish an agricultural levy

The following diagram represents the key steps in the process of establishing or amending a levy. The guidelines provide guidance to industry on each part of the process that will require their input.

The steps for preparing an industry proposal for a new or amended levy. Step 1 - Define the problem or opportunity Step 2 - Design your levy Step 3 - Consult with industry Step 4 - Demonstrate industry support Step 5 - Draft and submit your levy proposal Step 6 - Hold an objection period Step 7 - if agreed by the Minister and Parliament, the levy becomes law.
